Overview

Welcome to Kapri Gallery.

The terms “Kapri Gallery,” “we,” “us,” and “our” refer to Kapri Gallery, an online retail business based in Calgary, Alberta, Canada. We operate the website kaprigallery.ca and provide access to its information, content, features, products, customer services, and related functionality collectively referred to as the “Services.”

Our online store is hosted by Shopify Inc. Shopify provides the ecommerce platform that enables us to offer products and Services to you. Purchases made through our store are transactions directly between you and Kapri Gallery.

These Terms of Service, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, Warranty Policy, and any other policies referenced on our website, govern your access to and use of the Services.

By accessing our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree, you must not access or use the Services.

Nothing in these Terms excludes, restricts, or replaces any right, condition, warranty, or remedy that cannot lawfully be excluded under applicable Canadian consumer protection legislation.

1. Eligibility and Use of the Services

By using the Services, you represent that you have reached the age of majority in your province or territory of residence or that you are using the Services with the permission and supervision of a parent or legal guardian.

You may use the Services only for lawful, personal, and non-commercial purposes unless we have provided prior written authorization for another use.

You must not use the Services in any way that:

  • violates any federal, provincial, territorial, municipal, or international law;
  • infringes the intellectual property, privacy, publicity, or other rights of another person;
  • introduces viruses, malicious code, or harmful technology;
  • attempts to gain unauthorized access to our website, systems, accounts, or data;
  • interferes with the security, availability, operation, or performance of the Services;
  • collects or extracts information from the Services through unauthorized scraping, crawling, automated extraction, or similar means;
  • places an unreasonable or disproportionate load on our systems;
  • uses false, misleading, fraudulent, abusive, or unlawful information.

We may restrict, suspend, or terminate access to the Services where we reasonably believe these Terms have been violated or where action is necessary to protect Kapri Gallery, our customers, Shopify, service providers, or third parties.

2. Account Information and Security

You may be permitted to create a customer account or use account-related features.

You are responsible for:

  • providing accurate, current, and complete account information;
  • maintaining the confidentiality of your login credentials;
  • all activity that occurs through your account;
  • notifying us promptly of suspected unauthorized access or use.

You must not sell, transfer, assign, or allow another person to misuse your account.

We may require verification of identity, billing details, payment authorization, or order information before accepting or fulfilling an order.

3. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, colours, materials, availability, pricing, and other product information are accurate.

However:

  • colours and finishes may appear differently depending on your screen, browser, lighting, and device settings;
  • measurements may be approximate;
  • natural materials may contain variations in texture, colour, pattern, grain, or finish;
  • product packaging may change without notice;
  • minor differences may exist between product batches;
  • manufacturer descriptions may occasionally contain translation, formatting, or catalogue errors.

Such reasonable variations are not necessarily defects.

We reserve the right to correct product information, update descriptions, discontinue products, limit quantities, and modify available styles, colours, sizes, or specifications without prior notice.

4. Jewelry Information and Care

Jewelry may be affected by moisture, cosmetics, perfume, chemicals, impact, friction, perspiration, improper storage, and ordinary wear.

Customers are responsible for following any product-specific care instructions supplied with the item or published on our website.

Unless expressly described otherwise, jewelry should not be assumed to be suitable for:

  • swimming;
  • showering or bathing;
  • sports or intensive physical activity;
  • exposure to household chemicals, cosmetics, perfumes, or cleaning agents;
  • continuous wear during sleep.

Plating, polishing, surface coatings, stones, clasps, chains, and other components may naturally show wear over time. Normal wear and gradual changes in appearance are not necessarily manufacturing defects.

5. Watch Straps, Sizes, and Compatibility

Customers are responsible for confirming the correct strap width, buckle size, connector type, fitting, and compatibility before placing an order.

Watch strap sizes are generally measured in millimetres at the point where the strap attaches between the watch lugs. The size shown in a product title or SKU may refer to the principal listed size and may not describe every available variant.

Before ordering, you should:

  • measure the distance between your watch lugs;
  • confirm whether your watch requires a standard spring bar, Easy Click fitting, smartwatch connector, curved end, or another connection system;
  • review the available size and buckle information;
  • contact us if compatibility is uncertain.

Kapri Gallery is not responsible for incompatibility caused by inaccurate customer measurements, incorrect watch information, or selection of an unsuitable connector or size.

This does not limit your ability to return an eligible unused item in accordance with our Refund & Return Policy.

6. Product Authenticity

Kapri Gallery is an official Morellato distributor in Canada. Morellato products sold through our store are represented as genuine and sourced through official or authorized distribution channels.

Brand names, trademarks, product images, collection names, logos, and manufacturer materials remain the property of their respective owners.

7. Orders

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted or that the products are available.

An order is accepted when we confirm fulfillment, dispatch the products, or otherwise expressly confirm acceptance.

We may refuse, hold, limit, or cancel an order where reasonably necessary, including because of:

  • inventory discrepancies;
  • incorrect product information or pricing;
  • suspected fraud or unauthorized payment activity;
  • shipping restrictions;
  • quantity limitations;
  • suspected commercial resale;
  • an inability to verify customer or payment information;
  • technical or system errors;
  • circumstances outside our reasonable control.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the cancelled amount.

8. Order Changes and Cancellations

Please review your order carefully before submitting it.

To request a change or cancellation, contact us promptly at info@kaprigallery.ca.

We cannot guarantee that changes or cancellations can be completed after an order has been submitted. Orders that have entered processing, been prepared for shipment, or shipped may need to be handled as returns under our Refund & Return Policy.

Personalized, engraved, resized, altered, custom-made, and special-order items cannot normally be cancelled after production or sourcing has begun.

9. Prices, Currency, and Taxes

Unless otherwise stated, all prices displayed on our Canadian store are in Canadian dollars (CAD).

Prices may change without notice. The price applicable to an accepted order will generally be the price shown during checkout, subject to the correction of obvious errors.

Applicable sales taxes and shipping charges are calculated and displayed during checkout.

Promotional pricing may be subject to separate conditions, including:

  • specific start and end dates;
  • minimum purchase requirements;
  • product or collection exclusions;
  • single-use or customer-specific discount codes;
  • limits on combination with other offers.

If promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.

10. Pricing and Listing Errors

Occasionally, product information may contain typographical errors, incorrect prices, inaccurate availability, or other omissions.

We reserve the right to correct errors and update information at any time.

If an obvious or material pricing or listing error affects an order, we may:

  • contact you for instructions;
  • offer to complete the order using the corrected information;
  • cancel the affected item or order and issue an appropriate refund.

We will not knowingly use misleading pricing or product information.

11. Payment

Available payment methods are displayed during checkout and may be processed by Shopify Payments or other third-party payment providers.

By submitting payment information, you represent that:

  • the information is accurate and complete;
  • you are authorized to use the selected payment method;
  • the payment provider may process the transaction;
  • you authorize us and our payment providers to collect the applicable order amount.

Kapri Gallery does not store complete payment card numbers. Payment information is processed by Shopify and applicable payment providers according to their own security and privacy practices.

We may delay fulfillment while payment authorization, fraud review, or identity verification is pending.

12. Shipping and Delivery

Our shipping destinations, processing periods, delivery estimates, rates, tracking procedures, and related conditions are described in our Shipping Policy.

Delivery times are estimates and are not guaranteed unless we expressly state otherwise.

Kapri Gallery is not responsible for delays caused by events outside our reasonable control, including:

  • carrier disruptions;
  • severe weather;
  • natural disasters;
  • labour interruptions;
  • transportation failures;
  • incorrect or incomplete customer addresses;
  • government action or emergencies.

Kapri Gallery remains responsible for fulfilling an accepted order until delivery to the shipping address supplied during checkout, subject to applicable law and the terms of our Shipping Policy.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping expenses caused by an incorrect, incomplete, refused, or undeliverable address may be charged to the customer where permitted by law.

13. Returns, Refunds, and Exchanges

Returns, refunds, damaged-item claims, order cancellations, and exchange procedures are governed by our Refund & Return Policy.

Our voluntary return policy does not limit any mandatory remedy available for defective, unsafe, incorrectly supplied, or materially misrepresented products.

14. Final Sale and Non-Returnable Products

Certain products may be marked as final sale or non-returnable, including items that raise hygiene, customization, or resale concerns.

Examples may include:

  • opened earrings or pierced jewelry;
  • engraved or personalized products;
  • resized or altered products;
  • custom and special-order products;
  • gift cards;
  • items clearly identified as final sale.

Final-sale status does not remove any remedy that must be provided for a defective, unsafe, incorrectly supplied, or materially misrepresented product under applicable law.

15. Gift Cards

Gift cards are subject to any specific conditions displayed when purchased.

Gift cards:

  • have no cash value except where required by law;
  • cannot ordinarily be redeemed for cash;
  • must be protected by the recipient like cash;
  • may not be replaced if lost, stolen, deleted, or used without authorization unless required by law.

Promotional cards, discount certificates, and complimentary credits may have expiration dates or additional restrictions where permitted by law.

16. Manufacturer and Product Warranties

Certain products may include a manufacturer warranty. Warranty periods, exclusions, and available remedies may differ depending on the product and manufacturer.

Manufacturer warranties are separate from our voluntary return policy and from any legal warranties or conditions that apply under Canadian law.

A warranty generally does not cover:

  • normal wear and tear;
  • accidental damage;
  • scratches, dents, or cosmetic deterioration caused by use;
  • damage caused by improper installation, storage, maintenance, or cleaning;
  • exposure to water, chemicals, cosmetics, heat, or other conditions contrary to care instructions;
  • unauthorized modification or repair;
  • damage caused by using an incompatible watch, clasp, buckle, connector, or accessory.

17. Optional Third-Party Tools and Services

The Services may provide access to tools, payment methods, applications, analytics, social media features, review systems, or other functionality operated by third parties.

Third-party tools are subject to the terms and privacy practices of their respective providers.

We do not control third-party services and are not responsible for their independent actions, availability, security, or content, except to the extent responsibility cannot lawfully be excluded.

18. Third-Party Links

Our website may include links to third-party websites or resources.

A link does not necessarily mean that Kapri Gallery endorses, controls, or guarantees the third party or its content.

You should review the terms, privacy policies, product information, and business practices of any third party before interacting with it or completing a transaction.

19. Relationship with Shopify

Kapri Gallery uses Shopify to host and operate its online store.

Products sold through our store are sold directly by Kapri Gallery, not Shopify. Shopify is not the seller, distributor, manufacturer, or warrantor of products purchased from Kapri Gallery.

Shopify may process information about your visit, account, checkout, and purchases to provide and improve its platform and services. Additional information is available in our Privacy Policy and Shopify’s applicable privacy documentation.

20. Privacy

Our collection, use, retention, processing, and disclosure of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that information may be processed by Shopify and service providers in Canada, the United States, or other jurisdictions, subject to applicable privacy law and contractual protections.

21. Reviews, Feedback, and User Content

If you voluntarily submit a product review, photograph, testimonial, suggestion, comment, or other content to us, you represent that:

  • you own the content or have permission to submit it;
  • the content is truthful and based on your genuine experience where represented as a review;
  • the content does not infringe another person’s rights;
  • the content is not defamatory, threatening, obscene, deceptive, unlawful, or malicious;
  • you have disclosed any material compensation or incentive connected with the submission.

You grant Kapri Gallery a non-exclusive, worldwide, royalty-free licence to reproduce, display, format, and use submitted content for operating, improving, and promoting the Services, subject to applicable privacy law.

We may moderate or remove content that violates these Terms, applicable law, platform rules, or the rights of another person.

We are not required to publish, retain, compensate, or respond to submitted content.

22. Intellectual Property

The Services and their original content, layout, branding, text, graphics, photographs, videos, product presentations, and design elements are owned by or licensed to Kapri Gallery and are protected by Canadian and international intellectual property laws.

You may access and use the Services for personal shopping and informational purposes.

Without prior written permission, you must not:

  • copy or republish substantial portions of the website;
  • use product images or descriptions for commercial resale;
  • modify, distribute, sell, licence, or create derivative commercial content from the Services;
  • remove copyright, trademark, or ownership notices;
  • use Kapri Gallery branding in a manner that suggests authorization, sponsorship, or affiliation.

Morellato, Shopify, and other third-party names, logos, collections, and product marks belong to their respective owners.

23. Website Availability

We aim to maintain reliable access to the Services but do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

We may temporarily restrict or suspend access for maintenance, security, updates, technical issues, or circumstances outside our reasonable control.

We are not responsible for minor interruptions or technical issues that do not result from our intentional misconduct or gross negligence, subject to applicable law.

24. Disclaimer Regarding Website Information

General information provided through the Services is intended for informational and shopping purposes and is not professional, legal, financial, medical, or technical advice.

We make reasonable efforts to keep the information accurate and current but cannot guarantee that every page will always be complete or error-free.

Product-specific statements made by a manufacturer may be subject to the manufacturer’s testing conditions, instructions, exclusions, and warranty terms.

25. Mandatory Consumer Rights

Products purchased for personal, family, or household use may be protected by statutory warranties, conditions, and remedies under applicable provincial, territorial, and federal laws.

Nothing in these Terms:

  • requires you to waive rights that cannot lawfully be waived;
  • excludes statutory warranties or conditions that cannot lawfully be excluded;
  • limits remedies that must be provided for defective, unsafe, incorrectly described, or incorrectly supplied products;
  • overrides applicable consumer protection legislation.

If a provision of these Terms conflicts with a mandatory legal right, the mandatory legal right will prevail.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Kapri Gallery will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the use of the Services where such damages were not reasonably foreseeable.

Where liability may lawfully be limited, Kapri Gallery’s aggregate liability arising from a particular order will not exceed the amount paid for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability arising from:

  • fraud or fraudulent misrepresentation;
  • gross negligence or wilful misconduct;
  • personal injury or death where liability cannot be excluded;
  • mandatory consumer rights and remedies;
  • any other matter for which exclusion or limitation is prohibited by law.

27. Customer Responsibility

You are responsible for losses, claims, or expenses reasonably arising from your deliberate unlawful use of the Services, infringement of third-party rights, or material violation of these Terms.

This provision does not require a consumer to indemnify Kapri Gallery for Kapri Gallery’s own negligence, breach of law, product defect, or conduct for which responsibility cannot lawfully be transferred.

28. Suspension and Termination

We may suspend or terminate access to the Services where we reasonably believe that:

  • you have materially violated these Terms;
  • your activity is fraudulent, unlawful, abusive, or harmful;
  • continued access presents a security or operational risk;
  • termination is required by law or a service provider.

Termination does not affect rights, payment obligations, accepted orders, claims, or provisions that arose before termination or that are intended to survive termination.

29. Events Outside Our Control

Kapri Gallery will not be responsible for a delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disaster, fire, flood, labour disruption, transportation interruption, government action, public emergency, internet failure, cyberattack, utility outage, supplier failure, or carrier disruption.

We will make reasonable efforts to communicate significant delays and complete or refund affected orders as appropriate.

30. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

31. No Waiver

If Kapri Gallery does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

A waiver is effective only if provided in writing by an authorized representative of Kapri Gallery.

32. Entire Agreement

These Terms and the policies incorporated by reference constitute the agreement between you and Kapri Gallery concerning the Services and supersede previous communications relating to the same subject.

Where a product page, promotion, warranty, or specific policy includes additional terms, those specific terms will apply to the relevant product, promotion, warranty, or transaction.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Kapri Gallery may assign these Terms as part of a legitimate sale, transfer, financing, restructuring, or reorganization of the business, provided that applicable consumer rights are not reduced.

34. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.

Nothing in this section deprives a consumer of any mandatory protection available under the laws of the province or territory in which the consumer resides.

35. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices, Shopify functionality, or applicable legal requirements.

The current version will be posted on this page with an updated revision date.

Where required by law, we will provide additional notice of material changes.

Changes will apply prospectively from their effective date and will not retroactively reduce rights associated with previously accepted orders.
